VETERAN PRIVACY

Understanding the policies and procedures gov­erning privacy is essential for Veterans and their families. While this article isn’t a legal guide, it of­fers insight into privacy laws impacting your Coun­ty Veterans Service Officer (CVSO).

The Freedom of Information Act (FOIA) of 1966 and the Privacy Act of 1974 are key federal laws governing access to records and the protection of personal information. The FOIA gives individuals the right to request and access records from the fed­eral government. The Privacy Act protects individ­uals from the collection, use, and disclosure of their personal information. The Department of Veterans Affairs (VA) implements and enforces privacy pol­icies relating to the FOIA and Privacy Act.

Your CVSO is a county employee affiliated with VA. Although accredited and certified, CVSOs have limited access to federal records about military ser­vice and benefits. It is important to note that Veter­ans Services offices are not record repositories.

Federal law prohibits CVSOs from sharing most information about a Veteran without written con­sent. Even with consent, some records remain un­der VA control and cannot be disclosed. This can be frustrating for family or friends trying to assist a Veteran, but your CVSO can help direct you to the proper authorities, explain the request process, and offer general information to support your ef­forts. For example, FOIA requests to the Nation­al Archives can help obtain service records. Your understanding and patience are always appreciated.

Your County Recorder’s office or Vital Records department may be a source for specific military documents. This emphasizes the importance of having your original DD-214 recorded, filed, and maintained by the Recorder’s office. While a certi­fied copy may be requested, the application must be made by the Veteran along with photo ID.

Privacy considerations also extend to public in­teractions. If your CVSO doesn’t acknowledge you in a public setting, it’s likely an effort to protect your privacy. Public recognition may inadvertently reveal your status as a Veteran or disclose your re­lationship with the CVSO. To maintain confidenti­ality, it’s best to limit these interactions to the office environment whenever possible.
