FINDINGS
The Town Board of Crystal Bay hereby finds:
- That it is in the best interests of the public safety and welfare to prohibit Camping on property owned by Crystal Bay Township (the “Town”).
- The purpose of this Ordinance is to protect the general health, safety, and welfare of the residents of the Town of Crystal Bay by prohibiting Camping on property owned by the Town or within the Town’s right of way.
ORDINANCE
Crystal Bay Township ordains as follows:
1. Definitions
a. “Camping” shall mean setting up a Campsite or creating or establishing a temporary place to live or sleep in a structure, vehicle or on the ground, without permit.
b. “Campsite” shall mean 1) any place where bedding, sleeping bags, tents, or other material are used for bedding, shelter, or sleeping purposes or 2) any place where a stove, a fire, or cooking instruments are placed or created for the purpose of establishing a temporary place to reside or sleep.
2. No person shall engage in Camping or other temporary lodging or sleeping place in or on any property owned by the Township or within the Township’s rights of way or easement rights except in areas specifically designated for such use by the Township.
3. Any violation of this Ordinance shall constitute a misdemeanor pursuant to Minn. Stat. §§ 366.01, subd. 10; 609.02, subd. 3. Each instance is deemed a separate punishable offense under this Ordinance. The Town may, in its discretion, seek any civil remedies available to it as well, including but not limited to injunctive relief. Any rights or remedies accruing to the Town under this ordinance or at law may be exercised independently or simultaneously with any other right or remedy.
4. This ordinance is effective upon its passage by the Town Board.
FORMALITIES
a. The Clerk of the Township is instructed to publish the Ordinance title and summary in the North Shore Journal newspaper in a type size no smaller than brevier or 8-point type. Minn. Stat. § 365.125, subd. 2.
b. The Clerk is instructed to record the Ordinance in the Town’s Ordinance book within twenty (20) days after publication of the title and summary. Proof of said publication shall be attached to the recorded Ordinance. Minn. Stat. § 365.125, subd. 5.
c. The Clerk is instructed to file a copy of the full text of the Ordinance with the County Law Library or its designated depository, and to place a copy of the full text of the Ordinance in the location named in the summary above, as well as placing a copy on the community library, as applicable. Minn. Stat. § 415.021.
